Legal Question in Family Law in New Jersey
Do I have a right to ask for more child support or custody?
I divorced my ex 9 years ago and he
has been paying me the same child
support. He was starting a business
at the time of divorce which allowed
him to have minimum income. I am
remarried now for 7 years and my
husband (stepfather to my daughter)
pays all of my daughters expenses
because the child support is so
insignificant care for all her needs.
We have joint custody with primary
residence with me. It is not fair for
my husband to pick up the slack of
my ex.

The passage of nine years should mean that his business, assuming it has survived, is producing significant income for the father.

If that much time has passed, then yes, you should be able to find out what his income is, and ask for increased child support if he has increased his income.
