Legal Question in Family Law in New Jersey

Child support

My father stopped paying child support when I was 15 yrs.old. I was neither emancipated nor was my mother earning a greater income than my father. He still had full visitation rights and even if he gave them up I still saw him regularly. He claims to have filed a paper stating that his parental rights were terminated. This was because he could not afford to pay, allegedly. Can I sue my father for back child support or have I lost all my rights for back payments? My mother claims she signed no such papers allowing him to terminate support.

Re: Child support

hi -

i think that your mom would have to be the one to file for back support, if the court order was originally for him to pay her. she should call the probation dept. in the county in which she lives. feel free to call me at 609 263-0089 if you have any questions. good luck !!
