Legal Question in Family Law in New Jersey

child support guidlines

i pay child support for five children,i love dearly. But i have issue in the way it is calculated in may case. I have the children 45% of the over nights in a year roughly 165 overnights. i believe the judge should use a shared parenting work sheet. But my problem is that he doesn't, he falls back on the fact that my ex does not make $52,000 a year for a household of six. I believe this is totally wrong for two reasons. One in our divorce decree we used a shared parenting work sheet, and we had the same amount of children and she was not even working full-time at the time. She earns 3 times what she was making then. And i might add niether of us make $52,000 a year, so i pay calculated on a sole-parenting work sheet though i clearly have the children nearly half the time. I also have two small children with my current wife, this is not about them. But the fact is we care for the children just as much as my ex does yet i get no credit for it. The judge said we have to bring him something different, in contrast to what the child support work sheet tells him to do. Please help me ..is there any case law or facts i can use to right this wrong. thank you theo

Re: child support guidlines

You need a lawyer to fight this for you. I agree with the other lawyers, this does not sound right.

Re: child support guidlines

I suggest you hire an attorney or hit the law library. However, I doubt the judge will change his mind. It sounds like you will need to file a motion, have it denied and then file an appeal.

What you are saying does not sound right. Did you have a lawyer? How long ago was this ruling made? Perhaps a motion could be made for reconsideration.
