Child Support Increase

My child support has been the same amount since my child was 1 years old. He is now 11. It is not paid through the State. I know he is making much more money now. I am a stay at home mom, as I remarried. He will not increase the support on his own. What can I do? The cost of living alone has increased and now that my son is older he is requiring more money for school, sports, gatherings, etc. Please advise.

Child support should be increased if his income goes up, yours goes down, childcare goes up or the children's needs increase due to age or other factors. However, if he will not agree, then you need a Judge's order forcing him to pay more.

To put it simply, you have hurt yourself and your son by letting it go this long. YOu should immediately file a motion asking for increased child support. YOu can try to do yourself, but it is a very good idea to hire a decent divorce attorney to do it for you and perhaps get a much better result than doing it on your own.
