Legal Question in Family Law in New Jersey

Child Support Increase for lack of visitation

Since, my ex-husband rarely sees our two children since our divorce in 2001, and actually goes 6-8 weeks apart without any visitation, can I request the courts increase my child support? I know he's had in increase in salary, as well, so that gives me one ground for a child support increase, but can not exercising visitation be another one?

Re: Child Support Increase for lack of visitation

A substantial change of circumstances is required to successfully apply for an increase in child support payments. An increase in income is one of those circumstances is one the failure to exercise visitation rights is not. 800 273 7933.

Re: Child Support Increase for lack of visitation

Thank you for your inquiry.

If your ex-husband received "overnight credits" when the child support amount was initially calculated, then you may be successful in obtaining an increase, although I do need to learn some more facts as well.

As it would be my pleasure to speak to you regarding your situation, please feel free to contact my office at 732 246 0909 to discuss same.

Very truly yours,
