Child Support

My ex left me and my son while we were in canada...we went there for his job ..We are all US citizens...he was on a work permit...i moved back to NJ after our Legal Separation was done in Canada....He is still in Canada with the girlfriend ....He lost his job in January...and is looking for a new job there....in april i am filing for divorce...my son and i will be in the US a year...he is not giving us any money for child support or alimony since he lost his job..He was making $180,000 US a year....i got a job for $28,000 and barely making it...how long into the divorce will the courts demand he start making child support payments even though he doesn't have a job...He is being served in april....He is over $12,000 owed to us..so far..between alimony and child support

I would expect that Canada and the United States are parties to a treaty which would allow you to enforce the Canadian support order NOW. Once the divorce action is started you should be able to obtain an order within the divorce action within a few weeks, assuming you are able to serve papers upon your husband.
