child support

i live in capemay county ,my son is 18 his father wants to stop child support, my son started college this fall. can he do this and is their any way that i can get him to help with college tuition.

Payment for college expenses

Divorced parents are required to pay for their child's college costs, in accordance with their ability to pay, subject to reasonable contributions from the child and any grants, loans, etc. that may be available. There is no automatic discontinuation of child support at age 18 in New Jersey. Keep in mind that this advice is based purely on the little bit of information that you have given to me. Parents, to the extent of their ability, are required to assist their children with their college related expenses if the children or child is enrolled in college full time and unemancipated.

The general rule in New Jersey is that child support shall continue until the emancipation. If your son is attending college full time, then he cannot stop paying. He also cannot stop paying without a Court Order.

NJ law requires parents to continue to financially support their children after 18 until emancipation. If your son is a full time college student, his father should still continue to pay child support. College contributions are a whole other story. There are factors that the Court must consider.
