Legal Question in Family Law in New Jersey

Child support for 2nd family

My husband has 2 children from a previous marriage, he pays $157.00 per week in child support and he has 1 life insurance policy through his employer which has the 2 kids names on it as beneficiaries and his ex as the trustee. We just had a child together in September. We have tried twice now to apply to the court for a reduction in child support to $100.00 per week and to be allowed to put our child's name on my husband's life insurance policy with a neutral third party as trustee for all 3 children. My husband makes a little under $40,000 a year. His ex makes a little over $40,000 a year. I make around $6,000 a year. We can not afford an attorney, she has had one on retainer for a few years now. Every time we apply to the court they deny us and grant her everything she wants. Do I have any right to sue his ex to allow my son to be on his Father's life insurance policy? I feel like my sons's rights don't matter as much as my husband's first 2 children and I don't know what else to do to protect him. Please help, I am desperate.

Re: Child support for 2nd family

It appears to me that you may have some right to have a reduction in child support. Unfortunately, either there are facts which, when revealed, will make it clear that you are not entitled to that relief, or you are not, to date, putting the information together well enough to convince the Court. This is what a lawyer would do for you. You do not have a direct action against the ex. Unfortunately, it seems to me that you will need to get a lawyer if you have any hope of gaining the relief you desire. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Again, I would urge you to contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. If you mention LawGuru, there will be no charge for your first consultation. Good luck! Rob Gleaner
