Child Support

I need to know whether NJ awards child support orders for children who are over the age of 18, but attending college full time. Even iif the parents are both paying portions (45%-55%) of the continuing educational costs, can the ''custodial'' parent file for child support for the child while the child is still in college? I appreciate any assistance and information you are able to provide. Thank you for your time.

Under the circumstances that you have described, child support is not awarded under the Child Support Guidelines. Rather, a determination needs to be made as to the needs of the child, balanced against the amount of time that the child will be at the respective parents households. A careful review of all facts and circumstances needs to be made. Only then, will an award of child support (if warranted) be given. The custodial parent can apply for child support for that portion of the year when the child is at home and actually receiving support from the custodial parent.
