Legal Question in Family Law in New Jersey
Child Support from Non-biological Parent-Ex-Spouse?
1.Biological Father was married to Mother at the time of conception; Mother filed fraudulant Divorce papers after child's birth stating no children. Mother files for child support from this Father. Judge relieves Father from support obligation and names me as putative Father as I signed Birth Certificate believing at the time I was the Father. I was not made a party to that action received no notice of that action. Mother then filed for support from me as ''Father'' of the child due to 8 yr. marital relationship. Mother admits fraudulent divorce and that I am not the child's father in the court papers-signing that she accepts punishment if statements are untrue. I requested Voluntary Recission of birth Certificate. First Divorce filed fraudulently voids Birth Certificate does it not? Judge held it over for hearing in two months..My Lawyer stating I will probably lose wants to offer reasonable settlement..the injustice of this appalls me..How can bio-Dad walk away scot free? I didn't stop him from knowing his child..Mother did through Fraud so estoppel doesn't apply? Emergent Appeal for Due Process violation thru the first Court Action not naming me or notifying me of the proceeding? Please help I know it is complicated...Thanks
