Legal Question in Family Law in New Jersey

child support, payment for medical insurance

My wife's first husband was ordered by the court to pay for his daughters medical insurance when 'presented with a bill' and to pay 75% of uncovered (deductable, patient portion, etc).

He agreed to pay me for covering his daughter under my group family plan, which comes from my employer. I could not get him a yearly bill, but was able to get a letter from the human resources department on the policy cost. As I have five people on the policy (his duaghter the fifth) he agreed to pay 20% (one fifth) of the total.

Each year I presented him with the written and signed letter from my companies human resources department, and at times I had sent him copies of the policy and/or letters from the groups actually providing the insurance (Guardian, VSP (vision), etc) in addition to the bills for all medical doctor visits and procedures undergone by his daughter (including many which were paid 100%, just so he could see the value of this insurance.\

He has now turned sent us a summons to NJ court because ''he realizes he never should have paid the health care premiums because he was never presented with a real 'bill' (and he has the word BILL in parenthesis in his legal paperwork).

He is suing my wife and I for return of 20,000

Should be an easy case that gets tossed rather quickly. His problem is with the court, not you. You could even sue for your attorneys fees.

I suggest you get a good attorney to combat this and knock this out very quickly! I have an office in Toms River and I would be happy to meet with you this weekend. My initial consultations are always free, so call me at 732/247/3340 to set up an appointment.
