Legal Question in Family Law in New Jersey

Child support and remarriage of custodial parent

My husbands ex-wife remarried and they have a child together. She is now unemployed.

Does her new husband become financially responsible for the children now 15 and 18? Although their final settlement states that child support is terminated on the childrens 18th birthdays we now find ourselves being dragged into court to continue paying.

Re: Child support and remarriage of custodial parent

Her husband is not responsible for another man's children unless he were to adopt them. Child support is the child's entitlement and can not be bargained away. If the child enrolls in college

after graduating from high school the child is entitled to support while attending college full time even if the parents made some other arrangement in settlling the divorce case.

More details might to a slightly different answer.
