Legal Question in Family Law in New Jersey

child support/ rights as the custodial parent

My Question has two parts.

First, as the residential cusodial parent of my child I know that I need permission for his father to move out fo the state, but are there any milage restrictions on how far I can move within new jersey.

Second, my ex spouse never pays his child support on the scheduled day. We have been to court a dozen times about this matter and each time the judge orders him to pay more. This doesn't help me b/c he still does not pay on time. He does not have a steady pay check b/c he is self employed so they can not have the money taken out automatically. This is become a huge burden on my life, bills, and child. Is there anything I or the courts can do to assure I get the money on time.

New Jersey is not a very big state. Unless there is a mileage restriction in a Court Order or property settlement agreement you can move anywhere in New Jersey without permission.

You problem seems to be that the father does not have a reliable source of income. The only protection I can think of is that he be required to pay two weeks in advance so that when his payment is late it is not really late.

Call me if you like.
