Child Support

My son is 12 and I have never received child support for him since he was born. How much would I receive per month for him if the child support order goes through, even though his father isn't working?

It depends on why the father is not working. Is he disabled? Normally, income would be imputed to the father based on the work he usually does and/or is qualifed to do.

In addition to Mr. Moore's comments, keep in mind that you will not receive any past child support as well unless there was an order in effect, which it appears there wasn't.

Imputing income is not suppose be automatic although it will be if you get the right judge. To be sure you get the correct amount, you may want to hire a lawyer. Its a quick process and it should't be expensive for you. Its usually only one court appearance. Sometimes, your lawyer is the only person that knows what they are doing when it comes to child support issues, I've got horror stories I can share with you!
