Legal Question in Family Law in New Jersey

Child support

My son just turned 18. He lives with his mother. We were never married. He failed his senior year of school. I filed a motion in Sept. for emmancipation. She wants to move out of sate with him and says he will return to school and repeat his senior year there. Do I still have to pay support if she moves with me agreeing to it? do I have any rights in this matter?

Re: Child support

You will have to pay child support until the Court declares him emancipated.

If you do not have a lawyer, get one.

Yes you have rights in this matter, but it is not possible to answer your questions fully over this bulletin board.

Re: Child support

I know next to nothing about laws from other states. However, if she moves and then the case goes to a new court you "may" get out of paying for college. I would suggest you contact a lawyer in the state she plans to move to and pay him or her for a consultation to get an opinion on that question.

My intial consultations are always free, so call me at 732/247/3340 to discuss your case.
