Legal Question in Family Law in New Jersey
Child support and how it's spent
I am the father and I just finally took my ex girlfriend to court for support. I have had custody since 2004. She just started paying. She is demanding that I purchase ski equipment gear/outerwear/ticket for my son at her house. This is something she does with her own family. I refuse to have the support money giving right back to her to help her financially. My son thinks it is wrong as well. Am I obligated to give her money for these items. She is now also complaining that she spends $12 in lunch for him while she is with him. I am obligated to give her money for this minimal amount. I told her I have no problem sending him with everyday clothing but I refuse to buy skiing items for her benefit. That's giving her the support right back. Please note that my son may only go once this year skiing. Further making her request absurd. I told her support payments will be applied to things like food, shelter, and clothing. Her families extra activities are not my responsibility. Please correct me if I am wrong. Thanks.

Re: Child support and how it's spent
You are acting correctly. Any extras she wants to do with him she can pay for; a Court would not require you to reimburse her for ski wear, equipment or the costs of the trip. Further, her lunch money is included in the child support guidelines with her credit for her overnights.

You are acting correctly. If she wants to provide additional clothing
for your child she should do it.
Call me if you like.
