Legal Question in Family Law in New Jersey

Child Support and New Spouses Income

I am about to get remarried and I am currently paying child support for my two older children to my exhusband.

Will my new husbands income become a factor for this child support issue when we get married? We can not find anyone to give us a straight answer in this matter. Thank you in advance.

Re: Child Support and New Spouses Income

In most cases, the new spouse's income is immaterial to a child support calculation. The exceptions would include a case of extreme changes in family financial circumstance and where alimony would disappear because of the marriage. However, for most part, the child support calculation would not change. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. If you have not retained an attorney, before you take any action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. If you mention Law Guru, there will be no charge for your first consultation. Good luck! Rob Gleaner

It is the average weekly income of the parents which determines the amount of child support and not the income of their spouses. You can call me at 800 273 7933.
