child support/emancipation event
will my son still be eligable to recieve child support payments to continue graduate school? the settlement agreement reads: an emancipation event shall occur at age 18 or the completion of up to four academic years of college edu. whichever last occurs; notwithstanding anything contained in sub-paragraph above, an emancipation event shall be deemed deferred beyond age 21 only if and so long as the child pursues college edu. with reasonable diligence and on a normally continuous basis.

You will want to file a motion to terminate child support. A divorce lawyer will help you a great deal to get that done.

Is this a hypothetical question or is the son about to enter graduate school? The somewhat tedious language of the agreement may be helpful in resisting an application for emancipation. There are many variables and the case law may yield different results. A lawyer will need more information to respond to your question.
