Legal Question in Family Law in New Jersey

Child turned down 2 scholarships to college

MY Daughter turned down two scholarships to attend college

in my divorce agreement it stated child will apply for and accept all ''scholarships and loans'' and parents based on their ability to pay will help with any other payments.

Having turned down 2 scholarships and my daughter is of age of majority should my disabled veterans benefits be used for support since she and my ex wife made this decision without my input? I am currently on a disability

pension from my job and also receive VA benefits that are exempt from any legal proceedings. I also asked for a modification since I do not earn what I used to and I have to pay almost $200.00 a month for health insurance to keep the same benefits that I had when I was working also since my daughter made this decision can I ask for her to be emancipated?

Re: Child turned down 2 scholarships to college

A lot depends on the exact wording of your divorce judgment and (if there was one) the settlement agreement. if she was required to apply for and accept scholarships (which usually is the language used) then when she did not that should probably reduce your obligations. i am not able to state that for certain.

You need an attorney to fight this for you.
