child visitation rights

My girlfreind & I have split & have a 5 month old daughter. For now she is still only allowing me daytime visits.(my 2 days off from work)Can she make the rules?? I only get to see my child 16-20 hours a week?? Must I file civil action against her for visitation?? Also I live in NY but baby & mother live in NJ. Where would I file? NY or NJ??

You must file in your complaint in the state where the child resides, New Jersey

Have you considered filing a petition for visitation or joint custody?

The petition for visitation should be filed in the state where the child lives.
