Legal Question in Family Law in New Jersey
Children refuse to go to visitations
I have two children 8 and 10 years old. There is a FRO in effect since early 1998 and divorce agreement since 1999. My ex violated FRO several times and already served probation and went for anger management. A year ago the scheduled visitations were stopped, because he hit my mother when picking up the children. Unfortunately this criminal matter was downgraded to harassment and the trial is still pending. The psychological evaluation recommends unsupervised visitation even though both children told the psychologist that they are scared of ex and that he hits them. The evaluation assumes that I set the children up against their father. Now the children are devastated and scared to go for unsupervised visitation. They say, ''he will kill us. They already complained to the school counselor and I received a very disturbing phone call from the school principal What can I do?

Fight it! But you need to have the ammunition. Testimony of independent counselors and/or psycologists, including school representatives, would be crucial. Unfortunately, this can get expensive. However, in light of the high stakes, it seems that you have no choice. You must keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly could be factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. If you have not retained an attorney, before you take any action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. If you mention Law Guru, there will be no charge for your first consultation. Good luck! Rob Gleaner

You need a second opinion by a highly qualified psychiatrist and then a motion for reconsideration. Sounds expensive. You can call me at 800 273 7933.
