Children's Rights

If I die can my husband give our kids to the State for adoption? Even with a family willing and able to care for them? Even with a letter from me requesting it? He says he can, but I can't imagine ANY judge would allow it. Pls advs.

I would think that your family should be prepared to act immediately if something happens to you. The Court will prefer that your children stay with their family.

There may be "interested parties" such as your parents that may petition the court. That being said, your husband would be able to give them up for adoption, depending on the situation. The judge will look to the best interest of the child.
