A Child's Right to choose a Custodial Parent.
In the state of New Jersey, is there a legal age, other than the age of eighteen, after which a child of divorced parents can choose the parent with whom he or she wants to live regardless of the decision for custodial parent in the original decree of divorce? I've been told by some that after the age of thirteen in New Jersey, a child may choose the parent with whom he or she wants to live.

By the age of 13 or 14 the Courts will take into account what the child wishes, but it still takes a formal motion and possible hearing for the Judge to decide and it is based on the best interest of the child. This may not be what the child wants. If you need more information, contact
