Legal Question in Family Law in New Jersey

childsupport payments

Last month my son's father and I went to court for child support. He has to pay $232 a week and has not paid a dollar. How long does he have to go not paying for childsupport till he gets arrested or some sort of other action is taken against him?

Re: childsupport payments

Have you filed for contempt yet?

How long has it been since the Order to pay support was issued?

Sincerely,

Re: childsupport payments

Unless he is paying through probation, he will never get arrested. If he is paying through probation, get probation to take care of it. They usually give him 3 missed payments until they start to ask for warrants. If he is not making payments through probation, you will have to file a motion to get a bench warrant.

I don't think you need an attorney at this point, but you should at least consult with one.

He will get away with not paying until you ask the Court to take strong action against him.
