college tuition

hi, is a father legally obligated to pay tuition for an 18 year old child. i live in delaware child lives with mother my ex wife, in new jersey .i was divorced when i lived in new jersey, and since have moved to delaware.i can not afford to pay for the college of her choice.

In NJ, the divorced parents are required to pay the balance of the college costs in accordance with their ability to pay. This balance is calculated after all applicable loans, grants, scholarships, etc. In order to calculate the ability to pay, a comparison of the assets and incomes of the parties (and the child) is necessary. Keep in mind that this advice is based purely on the little bit ofinformation that you have given to me. There certainly may be other factors that would change my opinion. Yes, New Jersey law generally requires parents to contribute to the college education of their children and may require continued child support during college. Also, since your child lives in New Jersey, it is likely, although not absolute, that New Jersey would assert jurisdiction over this issue and apply New Jersey law.
