Legal Question in Family Law in New Jersey
complicated question
Please answer my question as in depth as possible. My son is 2 years old and is currently in the care of his maternal grandmother Ive spent a year filing motions to get a paternity test simply because the mother of my son told me he wasnt mine. During this year she cut me off completely just today I found out she has been incarcerated for a year for murder no one informed me not even the court officers who I was in constant contact with told me she was incarcerated the paternity results came back and he is indeed my son the only reason I found out that he wasnt with his mother was beacuse i received a subpoena to appear in court because his grandmother is filing for temporary custody I want my son. I want full custody what can I do and as the natural father do I have rights i can excercise right now to get my son please let me know something asap I am contacting a lawyer but I would like to hear other legal opinions

Re: complicated question
It's not so complicated. You should file your ownn custody complaint and ask that it be scheduled for the same date as the grandmothers.
You must tell the Court your entire scenario; that you were deceived into temporarily believing he was not your son; that did not realized your child was being cared for by the mother and that the grandmother should not benefit from her concealing this information.
Call me if you like.

Re: complicated question
I agree with Mr. Moore, there's a simple answer: just file the motion! It just comes down to how well the motion is backed up by the facts and the law and what happens in court.
