Legal Question in Family Law in New Jersey

Ex not complying with something in divorce decree

Hi, just wanted to find out what motion I have to file. It is in our divorce decree that we both have to put $400 each out for our taxes for 2007 that were filed jointly and never picked up from acct. 500 for acct fee, 300 we owe to 2007 return. It is ordered we are to pay 400 each. I paid my half last week. Ex has not paid. Called IRS as I received letter and they said if it's not received by March 20th they will assess return with full income and no write-offs, which means we can owe thousands instead of 300.

I texted him to ask him quote, ''When are you paying your half? Mine was paid last week.'' His response was ''Drop Dead.''

I have to immediately go to court and file a motion, as I am very stressed over what can happen with the taxes and he is holding up my 2008 from being filed.

Should I file a ''Motion to enforce litigant's rights.'' is that the correct motion? do I attach anything to the motion, i.e., copy of the page of divorce decree that states above, and also I printed up the two texts of me asking him and his kind response. Thank you for your help

You really should get a lawyer to help you. You have thousands of dollars at risk, you say. So get a lawyer.

With an idiot exhusband like this, you will definitely have other troubles, and a smart lawyer can help you plan and avoid some of the grief.

Let me know if I can help you. I am in Hackensack, right across from the Bergen County Courthouse.
