You need me, of course! Seriously, you will need an attorney who handles divorce for the issues associated with your son. Your attorney also needs to know how to handle real estate disputes.

This close to Christmas, I am sorry to hear of your trouble. Please contact me to set an appointment, and I will see what I can do for you. I will be out until January 4, 2005.

My contact information can be obtained from the links below.

Of course, you can not rely on the advice of an attorney given over the internet. Also, the exact facts of your situation, including facts which you have not mentioned in your question, may completely change the result for your situation.

You will have to plan to move out, while filing a custody/visitation complaint with the Family Part of the Chancery Division of the Superior Court of New Jersey in your county while filing another action to sell the house and divide the equity.

You will have to take special care about telling her about your plans until you are in a safe place. You are vulnerable to domestic violence and criminal charges if she is ruthless.

You must avoid overreacting to her pushing your buttons because that empower her to use a domestic violence complaint to evict you from the house. If she is truly ruthless she might attempt to charge you with sexual misconduct with the child or sexual assault upon her.

Because you are not married to her you are not required to pay alimony or share with her your assets other than the house, but to obtain your rightful interest in the house she will have to either refinance or the house must be sold. If she will not do either of these things voluntarily you will have to file a lawsuit against her to achieve same.

You need a lawyer who practices family law because of the custody/visitation issues. The same attorney should be able to handle the house issues.

Good luck!
