Legal Question in Family Law in New Jersey
My ex took me to court in an attempt to modify a standing custody order in which I had sole custody. He was seeking partial custody, unsupervised, and over night visitation. He has 2 prior drug convictions. He was sentenced to 3-6years, was released from prison last August, and is currently on parole. The outcome was that the current order stay in place, my ex must complete a series of classes that he must pay for to obtain unsupervised visits, a home inspection be done for overnight visits, and that he go downstairs and take a drug test immediately after receiving his paperwork. He ripped up the papers and left without taking the drug test.
Will his refusal of the drug test have any legal repercussions being that he is on parole? Does it count as a parole violation even though it wasn't ordered by his parole officer? And is there anyway for him to obtain any kind of custody or unsupervised visits after his refusal to cooperate?
