Legal Question in Family Law in New Jersey

Court ordered custody of grandchild & child support

My wife and I have a court order for full custody of my five year old grand-daughter. The child's mother is my daughter from my first marriage. My wife moved out of our home and I am taking care of my grand-daughter. My wife cares for her one day and two nights a week. How would child custody laws apply to my situation if it comes to a divorce ? Is there a legal difference between custody and adoption ?

Re: Court ordered custody of grandchild & child support

You have a very complicated question which actually raises more questions, in my mind, than answers. I would need to explore with you the reason that you do have custody (for instance, what was the status of the mother that led a judge to give you the child? Has it changed now? What of the father?, etc.) Further, what would be the status of you and your wife? Which grandparent could serve as the better custodial parent, in the best interest of the child? None of this can be established by the information that you have given me. I would suggest that you immediately seek the advice of a Family Law attorney.
