Legal Question in Family Law in New Jersey

Court Ordered Emancipation & Probation Dept.

I filed for emancipation pro se and was awarded my request. My ex wife never responded to my motion though she had plenty of time to. My problem now is with the Middlesex Probation still taking out the child support. I have overpaid by 3 weeks already and they still will not adjust there records. Everytime I call they keep saying we have 2 days to call you back. Meanwhile the CS amount keeps adding up. Its over. How can I get them to obey the judge's order and close out the account? I have faxed them the order and every time I call they say well we don't see that order. These people make everything more difficult then it is,really.

Re: Court Ordered Emancipation & Probation Dept.

As an attorney, I never have a problem with this so I assume you didn't have one. Well you did a good job in winning the motion which was not a sure thing even though she didn't respond, but now you still have this problem. You could file another motion and direct the court to deal with it but once the money stops going ot her, she may come to court and fight you on the original motion. If you can't get anywhere with probation, it might make sense to have an attorney help you.
