Custodial parent dies

I know man who is not the custodial parent. The mother just passed away. Does he have to go to Court to get custody or is it automatic if no family members file for custody or guardianship?

The custody order's effectiveness died with the mother. He should simply pick up his children.

He should obtain a copy of the death certificate to counter any attempt to use the order granting

custody against him.
