custodial parent nad relocation

I am the custodial parent of my child. My court order states that we have ''joint legal'' of my child. He has her twice a month and three weeks in the summer. The child resides with me and always has. I am now married and have more children. We would like to move out of state. Relocation was never addressed in the courts, can

we move?

You can move outside of New Jersey permanently with either the father's consent or a court order.

You need either the child's father's permission, or you need to get an Order from the Court saying that you can. You would need to file a 'Motion" to request this, and take the necessary legal steps.

The Court Clerk or Legal Aid might, perhaps, help you to do this, if you have no way to hire an attorney.

If he does not consent, and I'm sure he won't, you need to file a motion. I suggest you see an attorney as these motions are very complicated. I have several right now and an expert is needed in about half the cases.
