who gets custody?

i am attempting to obtain custody of my eleven year old sister. she is currently living with me and attending the local elemenatary school and has been for almost a year. i havent recieved any child support from my mother or my sisters father. In order for me to get child support i need legal guardianship. My mother refuses to sign over custody to me and i dont know what else to do. What steps should i take to get custody? What documents should i present to family court? In the past year my sister has lived with me, has shown considerable improvement in school and after school related activities. Shes made new friends and is fitting in very well. It is my goal to ground her in a stable and socialble environment. It is my belief that my mother is an unfit parent and is in my sisters best interest and that she resides with me.

You can file to act as legal guardian of your sister, and move to terminate the parental rights of her parents. You should contact DYFS as soon as possible to obtain as much information on this matter as possible.
