Legal Question in Family Law in New Jersey

Custody Change

My 14 year old daughter currently lives with her Mother who has primary custody. I am on Active Duty, stationed in Japan on Shore duty. My daughter wants to live with me & her Mother is willing to go along with this. How difficult will this be to get the Court to approve & change Legal Custody & the current order for child support? What is required thru the Courts to complete this ? Do you have any estimates for a timeline & total costs?

Re: Custody Change

Since your daughter's mother is willing to consent to the custody change, it shouldn't be that hard for you to do it. If you can get your daughter's mother to agree to a formal custody agreement with court approval, then this should resolve your issue. Ultimately, what will matter most is what is in the best interests of the child.

You can give me a call to discuss.

Re: Custody Change

Since she consents, you really don't even need to go to court, but you should just to be safe. All you have to do is file a motion and have her sign a consent order. File that with your motion. Should be no problem. I doubt you need an attorney. Your only problem is dealing with the courts all the way from Japan.

If that's really a problem, can help you for a nominal fee.
