Legal Question in Family Law in New Jersey

custody of a child out of wedlock

My husband in the course of an extramarital affair has gotten a single woman pregnant. We have reconciled but wouldlike to have joint custody and/or liberal visitation with the child. The mother insists my husband has no rights. What is the normal response from the court in this situatuion regarding custody and visitation.

Re: custody of a child out of wedlock

Your husband certainly has rights as the father of the child. You or your attorney would seek to have the Court set a visitation schedule. Also, it is likely that the Court would designate joint legal custody with residential, physical custody to the mother.
