Legal Question in Family Law in New Jersey

custody

I am 7 months pregnant moved away from baby's daddy because he was threating to kill me and he continue to harass me. He has a history of violence and drug abuse. I have a temporary restraining order and went to get it finalized but he didn't appear to court. He continues to harass me and threaten to take my son away from me. We were never married. I need some legal advice and help to protect my self and my unborn child.

Re: custody

If the Temporary restraining order is still in effect, you can file a criminal complaint against him for violating that Order. If not, you should apply for a new TRO. Either way, contact the local police.

Re: custody

Did they serve him with the TRO? If not, try to find out where he is so they can serve him. I would also file a criminal charge for harrassment and ask the court to make a condition of bail that he have no contact with you.

I would be happy to follow up with you. Please email me directly or call my office if you would like to schedule an appointment either in person or by telephone. My contact information is listed in the links below.

Re: custody

Have you called the police when this man harasses you and advised them that you have a temporary order of protection?

How many times has this man failed to appear in court?

Are you planning on filing for sole custody once the child is born?
