Custody petition and having moved

I was served with papers from my ex-boyfriend for full custody of my youngest child, we were never married. We had lived in NJ but broke up months ago. I was being evicted and having no where to go, I contacted my husband, whom I never divorced and is the father of my oldest daughter of 3 years. We started talking about getting back together and before I knew it, he came to get me (we resided in FL) and here I am. What can I do now to not loose custody of my youngest?

You need to fight the case. You have to respond to his allegations and then show why you can provide a good home for the child. Your eviction will certainly not help you, so you need to be able to explain that. I suggest you get an attorney since you seem very concerned that you may lose custody.

You need to hire an attorney to fight losing custody. You took your child out of the state without the Court's permission or the father's consent but

that just how it is.

You do have the excuse that you had a parental duty to provide for your child, immediately, in the face of being evicted.
