Legal Question in Family Law in New Jersey

Custody Possibilities

My daughter is 24 and the unwed mother of a two-year-old. She was never married to the child's father, but after establishing paternity, he pays child support. He and his mother also have an oral visitation agreement, and they take the child every other weekend. He stays at the grandmother's house, and the father, who recently moved from NJ to Pennsylvania (but close by), visits him there.

My daughter does not have a will and has not named a legal guardian for the child. In the event that something were to happen to her, would custody automatically be awarded to the father? She has often expressed that she would not want him raised by the father and his family, but would want me to do it; I didn't want to urge her to put it in writing until I knew what the legal technicalities were.
