Legal Question in Family Law in New Jersey

Custody and Proof of service.

I obtained temporary custody of my 3 children in New Jersey after my wife abandoned us. There has been no proof of service of any court papers, due to the fact I did not have a address other than her last known.

DOes this prevent prevent me from receiving permanent custody?

I have recently received divorce papers from Vermont from her which lists an address for her. How can this new information help in my custody case that is in New Jersey?

Re: Custody and Proof of service.

Thank you for your inquiry.

I certainly believe that you have a case for permanent custody. But I need to learn more about the divorce action that she filed in Vermont, because New Jersey should have jurisdiction over the children.

It would be my pleasure to speak to you about your potential divorce. Accordingly, please feel free to contact my office at 732 246 0909 to discuss further.

Very truly yours,

Edward R. Weinstein
