Custody

My son's father wants to take me to court for residentil custody, when we already have joint custody because he feel he can teach him more and better things than me. He feels my 5 year old son should know certain things as far as school goes.I feel some kids are just slower learners. My question is, do you think the judge will grant him that because i am a single parent.

Your husband is a single parent also. Since all custody decisions are based on the best interests of the child, when called upon, the Court will need to make a determination as to who would be the better residential parent under all of the circumstances presented. That decision could not be made, however, until all facts and circumstances are presented and probably after substantial information is exchanged between the parties in addition to home studies of both parents. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, and since this issue is quite substantial, you should definitely contact an attorney (either me or someone else) to discuss your matter in more detail. I believe that the father of your child has a tough case because courts are hesitant to change residential custody of young children. However, if he were to proceed with an application to the Court, it is quite important that you obtain legal representation.
