Custody of unborn baby

My exboyfriend and I are no longer together and we both want custody of the baby. But I have been doing my part for the baby and he has done nothing, he wants me to be responiable for it. The problem for him is that he has a drug charge on him and is on probation for 3yrs with no g.e.d or high school diploma but i have a clean record and a high school diploma. can he still get custody of the child with a 1st drug charge?

He could, but its very doubtful. I don't think you have much to worry about.
