My 19 year old son was arrested recently for a small amount of marijuana found in his car, he got a conditional discharge. My ex is taking me to court (we have a 10 year old girl we were never married and he is not my son's father) trying to get custody of my daughter over this incident. My son is a good boy who made a mistake, he goes to vocational school 2 hors a day and works everyday at his job since high school--name removed--I have multiple sclerosis and the stress of this worry is making me sick I hope you will be able to tell me if I really need to worry about this. It would depend on the why he feels there is a change in circumstances that would justify a change in custody.
He has the burden to show a change and how this would impact on the current arrangement.
