Custody

My 16 yrold daughter lives with her father and his wife i have called dyfs several times on them for hitting my daughter and they always close the case. he hit her on wed. night and i want to know if she comes here and refuses to go back to his house will i be in trouble and also can i press charges againest him for punching her in the face. thank you

You can file a domestic violence complaint against him on behalf of your daughter and file a criminal complaint against him based on the assaults.

You question contains several issues. If DYFS will not proceed, you can still file charges. You would need to contact the police in the town where the alleged assault took place.

Next, regarding custody, you can file an emergent application with the Court to change custody. I would suggest you hire a lawyer to assist you with this process. However, if you need assistance, call the family court in the county where you live.
