It depends on the maturity of the child. There is no actual statutory age. If the issue were brought to the attention of the Court, in the judge's discretion, he/she could choose to interview the child to make a determination as to how much, if any, the child's wishes should be taken into consideration. It would, in any case, be only one factor in the ultimate determination as to the residency of the child. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion.
