dad's company on stike, claims he ''can't pay'' support

I browsed past responses, but was

unable to find information related to

my situation. I receive $80 a week

in child support that is taken directly

out of dad's pay by the probation

department (NJ.)

His company went on strike, so he is

not going to be paid. He says that I

will still get paid, although if the

probation department isn't getting

the $ from his employer, I am sure

that I am not going to get it. He

says that he will be ''thrown in jail''

(I think that he is looking for me to

''forgive him'' of his support

obligation, which I won't do.) In NJ,

what happens when the support

amount is not paid to the probation

department from the employer? Do

I receive the back payments once his

company's stike ends? (He has not

filed for a reduction in support, or a

stay of support since he does not

know how long the strike will last.) I

depend on that support, and I am

nervous about this situation. Thank

You would have to ask your local probation office. Generally, an arrears account will start. A court has to order that he has to pay an additional amount per week to start paying down on the arrears.
