Def. left state

HI I was in the middle of a custody battle with my ex boyfriend. We were scheduled for a court date on the 18th. He has moved out of state to Denver--name removed-- He said he faxed a letter to the courts letting them know. Is this legal? Will I win by default if he does not show up?

Assuming that he left the child with you, if he fails to appear you win custody by default.
