denied emancipation based on proof of service it says defendant fails to show proof of service his motion will be dismissed i filed all the papers was notified by phone of court date but live in another state and was told i didnt have to show up for the hearing is this because they couldnt serve my ex wife that it was dismissed

Due process of law means that a person has the right to be noticed as to a complaint filed against him and the opportunity to appear at any hearing and defend himself. This right is the basis for the requirement that a moving party or plaintiff provide proof of service of the papers filed with the Court.
