Legal Question in Family Law in New Jersey

I recently had a baby and the father was present when the baby was born. THe father hasa drinking problem and when I was in the hospital a fight broke out because he was drunk. DFYS was called because the hospital thought it would be best. He has been going to AA and is currently looking into a detox facility. However, over the weekend he ended up getting drunk and DFYS and the police were called. He spent 5 days in jail. He claims this has changed him. The questions I have are does DFYS have a right to bar him from the home when no harm was done to either me, my other children or the baby? The police have said since he paid rent he is entitle to stay here until the end of the month. He never hit me or my other children. ALso, do I have to file for full custody if DFYS wants me to? I do not want to have my children taken away and am willing to comply with DFYS

drunk and raging around the hospital, starts a fight and the cops have to take him out? that is completely outrageous, and he is very likely guilty of the crime of assault. and in a hospital. he endangered many people who are sick and in the hospital for treatment; he interfered with the doctors, nurses and medical people who were trying to help the patients. He is a horrible person and you should run the other way and have nothing to do with him again. but you are not listening. i just can not say nothing.

your legal questions: he obviously has serious problems which could be very dangerous to you and your children. DYFS is right to be very concerned for the children. if you want legal advice, then i suggest you find and hire (pay) an attorney who deals with DYFS matters, who is located not too far away from you.

Please get away from this man. You are at risk. Your kids are at risk. NO, you can not fix him, and NO, a week in jail has not made him a better person.
