Division of 401K Stocks

Upon divorce, does the ex get 1/2 the number iof shares or 1/2 the dollar value at time of filing? What happens if stocks drop and value decreases before final judgement?

You get what you settle for. I am sure you have an attorney, so I suggest you discuss all this with him or her. You could set this up however you want. In my cases, I try to work out some type of set off to avoid all this; i.e. in exchange for waiver of 401k, my client gets x.

She or he would get one half of the value of the stocks at the time of distribution.
